1. Acceptance of Terms

By downloading, installing, or using Snapsmith ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is developed and maintained by Phuc Nguyen ("we", "us", or "our").

2. Description of Service

Snapsmith is a macOS application that allows users to design App Store screenshots. The App provides tools for device framing, text overlays, annotations, background customization, and multi-size export. The App is available as a free download with optional Pro features available through a one-time in-app purchase.

3. Free and Pro Versions

Snapsmith is available in two tiers:

• Free: Includes core functionality with up to 4 screenshots, solid color backgrounds, and up to 10 exports.
• Pro ($7.99, one-time purchase): Unlocks unlimited screenshots, all annotation tools, gradient and mesh backgrounds, localization support, unlimited exports, and all future updates to Pro features.

4. In-App Purchases

The Pro upgrade is a non-consumable in-app purchase processed through Apple's App Store. All payments are handled by Apple and are subject to Apple's terms and conditions. Refund requests must be directed to Apple, as we do not process payments directly.

5. Intellectual Property

The App, including its design, code, graphics, and documentation, is the intellectual property of Phuc Nguyen and is protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or commercial purposes in accordance with these Terms.

You retain full ownership of all content you create using Snapsmith, including screenshots, designs, and exported images. We claim no rights to your content.

6. Permitted Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App or any part thereof
• Remove or alter any proprietary notices or labels
• Use the App for any unlawful purpose
• Attempt to circumvent any licensing or usage restrictions

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the App.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
